As a Harris County Assistant District Attorney and Special Assistant to the U.S. Attorney’s Office, Major Offenders Section, I handled hundreds and hundreds of drug cases, including countless trials. I know what police are required to prove, and how to challenge their evidence, from search warrants to drug analysis experts.
Texas drug laws do not have sentencing guidelines, so a conviction could get you anywhere from 180 days in jail to life in prison, depending on the type and amount of drug, your knowledge of or level of involvement, and whether you participated in a conspiracy.
I defend clients against state charges involving all types and amounts drugs, particularly marijuana, methamphetamine, cocaine, crack cocaine and club drugs such as Xanax and Ecstasy. I also handle charges involving prescription drugs, including fraud, theft and manufacturing.
If I may offer two pieces of advice:
- No matter what police say, never voluntarily agree to a search of your vehicle or residence. Make investigators obtain a search warrant by demonstrating to a judge that they have enough evidence for probable cause.
- You have a constitutional right to remain silent; this silence can be verbal AND written. Do not make any verbal or written statements to police without an attorney.
